5. Your Legal Responsibilities

Business names
Sole traders and partnerships can start to trade under their own name straight away. Limited companies must always use a company name, which must be registered and certain restrictions apply e.g preventing the use of names already in existence.

If a business name is to be used, then both that name, the names of each partner and the company name (as applicable) must be clearly displayed at the business premises and on any stationery.

Trade regulations
Certain trading laws exist to protect both you and your customers, for example, trade descriptions act and sale of goods act.

Contact your local authority if you plan to use your home as your business premises, as restrictions may apply. The local authority should also be contacted if you intend to change the use of certain premises. You may also need a licence to trade.

Responsibilities towards employees and the public
The main regulations regarding the public and employees, of which every new business should be aware, include:

Health & Safety.

Hygiene.

Fire precautions.

Discrimination.

Official inspectors can investigate every business and heavy fines or even convictions can be imposed if standards are not met. Employees also have rights under various employment laws, such as the right to a minimum wage and a maximum number of working hours.
